SANTA CLARITA SPEED SKATING AND US Speed Skating Release of Liability and Waiver Agreement

NOTE: THIS FORM MUST BE READ AND ACKNOWLEDGED BEFORE THE PARTICIPANT IS PERMITTED TO TAKE PART IN ANY USS SANCTIONED ACTIVITIES WITH THE SANTA CLARITA SPEED SKATING CLUB.

IN CONSIDERATION of my involvement in the sport, activities, and events under the auspices of U.S. Speedskating and/or a USS Association and/or a USS Club, INCLUDING the USS Club known as the Santa Clarita Speed Skating Club, I acknowledge, appreciate, and agree that:

  1. I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS ASSOCIATED WITH THE SPORT OF SPEEDSKATING; both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERS;
  2. THROUGH MY PARTICIPATION IN ANY SPEEDSKATING ACTIVITY, I RISK BODILY INJURY, (INCLUDING PARALYSIS, DISMEMBERMENT, DISABILITY, AND DEATH), SICKNESS AND DISEASE (INCLUDING COMMUNICABLE DISEASES), AND EXPOSURE TO ADVERSE CONDITIONS (INCLUDING ISSUES WITH FACILITIES AND EQUIPMENT); and while particular rules of my sport, equipment, and personal training and discipline may reduce this risk, THIS RISK OF INJURY DOES EXIST, AS WELL AS THE RISK OF DAMAGE TO OR LOSS OF PROPERTY;
  3. I willingly agree to comply with the stated and customary terms and conditions for participation. If, however, I observe any unusual or unnecessary hazard during my presence or participation, I will bring such to the attention of the nearest coach or official; and,
  4. If medical or surgical emergencies occur, I hereby give my permission to the physician and hospital selected by the Santa Clarita Speed Skating Club to take appropriate steps on behalf of myself or my minor child to do all things necessary to protect my own or my minor child’s health and well-being.
  5. I hereby certify that the individual designated as the skater on this form is in good health and has no special medical considerations except as detailed below:

  1. I hereby agree to the use of any picture and/or video of myself or my minor child for advertising or promotional purposes
  2. I, FOR MYSELF, AND ON BEHALF OF MY HEIRS, ASSIGNS, PERSONAL REPRESENTATIVES, and NEXT OF KIN, HEREBY RELEASE, HOLD HARMLESS, and PROMISE NOT TO SUE US SPEEDSKATING, USS CLUBS (INCLUDING THE SANTA CLARITA SPEED SKATING CLUB), THE CITY OF SANTA CLARITA, AND THEIR UTILIZED VENUE (INCLUDING, BUT NOT LIMITED TO, THE CUBE SANTA CLARITA), THE INTERNATIONAL OLYMPIC COMMITTEE, THE UNITED STATES OLYMPIC COMMITTEE, THE INTERNATIONAL SKATING UNION OR OTHER SPONSORING ORGANIZATIONS, THEIR OFFICALS, VOLUNTEERS, STAFF, SPONSORS AND/OR AGENTS (“RELEASEES”) WITH RESPECT TO ANY AND ALL INJURY AND LOSS ARISING FROM MY PARTICIPATION, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, EXCEPT THAT WHICH IS THE RESULT OF GROSS NEGLIGENCE OR WANTON MISCONDUCT.
